Mineral Treasury operates this store and website, including all related information, content, features, tools, products, and services in order to provide you, the customer, with a curated shopping experience (the “Services”).
Mineral Treasury is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service (“Terms”), together with any policies referenced herein, describe your rights and responsibilities when you access or use our Services.

Mineral Treasury makes reasonable efforts to accurately represent the products offered through our online store. However, colors and appearance may vary depending on photography, lighting, your display, device settings, and other factors.
We do not guarantee that the appearance or color of a product on your screen will exactly match its appearance in person.
Product descriptions, prices, availability, and other information may be changed or corrected at any time without prior notice.
We reserve the right to discontinue products and to limit quantities offered to any person, geographic region, or jurisdiction.
Natural Mineral and Geological Specimens
Many products offered by Mineral Treasury are natural mineral, crystal, rock, fossil, gemstone, or other geological specimens.
Natural specimens are inherently unique. They may contain variations, inclusions, fractures, cleavages, matrix material, irregular surfaces, color variations, contact points, growth interruptions, or other naturally occurring characteristics. These characteristics are part of the natural formation of the specimen and are not necessarily defects or damage.
Unless otherwise stated, photographs of one-of-a-kind specimens are intended to represent the actual specimen being offered for sale.
We make reasonable efforts to photograph specimens accurately. Nevertheless, color, transparency, luster, fluorescence, reflectivity, and other visual characteristics may appear differently depending upon lighting conditions, photography equipment, image processing, screen calibration, and viewing device.
Measurements and Weight
Measurements and weights provided for specimens are approximate unless expressly stated otherwise.
Mineral specimens frequently have irregular shapes, making exact measurements difficult. Minor differences may result from measurement technique, rounding, display bases, mounting materials, specimen orientation, or equipment used.
Shipping weight may also differ from specimen weight because shipping weight can include display boxes, stands, protective material, and packaging.
Mineral Identification and Locality
Mineral identification, species, variety, locality, mine information, formation, chemical composition, rarity, geological information, and provenance are provided in good faith based upon information reasonably available to Mineral Treasury.
This information may originate from suppliers, previous collectors, specimen labels, reference materials, geological publications, visual identification, available provenance, or other sources.
Unless a listing expressly states that laboratory testing, professional analysis, or independent certification has been performed, information provided by Mineral Treasury should not be interpreted as laboratory certification or an absolute guarantee of scientific identification, locality, provenance, composition, or authenticity.
Mineral classifications and locality information may also change as scientific research, nomenclature, or available provenance information develops.
Educational and Metaphysical Information
Mineral Treasury may provide educational information concerning mineralogy, geology, history, collecting, cultural traditions, folklore, metaphysical beliefs, spiritual practices, or traditional uses associated with minerals and crystals.
Such information is provided for educational and informational purposes only.
Statements regarding metaphysical, spiritual, emotional, wellness, or healing properties represent traditional beliefs or commonly reported practices and are not medical claims.

Mineral Safety
Mineral and geological specimens are primarily sold as collectibles, educational specimens, or decorative objects unless otherwise stated.
Some specimens may contain sharp edges, fragile crystals, small components, heavy elements, naturally occurring metals, or other substances requiring appropriate handling.
Do not ingest mineral specimens or intentionally inhale mineral dust.
Customers are responsible for using reasonable care when handling specimens and for keeping specimens away from children and pets when appropriate.
SECTION 3 – ORDERS
When you place an order, you are making an offer to purchase products from Mineral Treasury.
We reserve the right to accept, reject, limit, or cancel an order for any lawful reason at our discretion, including suspected fraud, pricing errors, inventory errors, payment problems, or product availability.
An order is not considered accepted until payment has been successfully processed and we have confirmed the order.
Please review your order carefully before submitting it. Because many Mineral Treasury products are individual, one-of-a-kind specimens, we may be unable to accommodate cancellation requests once an order has entered fulfillment.
If we reject, modify, or cancel an order, we will make reasonable efforts to contact you using the information provided with the order.
Returns and refunds are governed by our Return and Refund Policy.
SECTION 4 – PRICES AND BILLING
Prices, discounts, promotions, and availability are subject to change without notice.
The price charged will generally be the price displayed at the time an order is placed, subject to correction of obvious errors.
Unless expressly stated otherwise, listed prices do not include applicable taxes, shipping, handling, customs duties, import fees, or other government-imposed charges.

Shipping and delivery times displayed by Mineral Treasury, Shopify, or shipping carriers are estimates and are not guaranteed unless expressly stated otherwise.
Mineral Treasury is not responsible for delays resulting from carrier operations, weather, natural disasters, transportation disruptions, incorrect addresses supplied by customers, customs processing, government action, or other events outside our reasonable control.
Customers are responsible for providing a complete and accurate delivery address.
Orders may be shipped using carriers such as USPS, UPS, or other available shipping providers.
Shipping charges may be calculated based upon destination, package dimensions, weight, carrier rates, service selected, and other applicable factors.
Free shipping promotions, when offered, are subject to the conditions displayed at checkout or in the applicable promotion.
Risk of loss and title transfer are subject to applicable law and carrier terms.
If a package arrives visibly damaged, customers should retain the packaging and contact Mineral Treasury promptly so that we can assist with the carrier claim process when applicable.

Returns, refunds, exchanges, cancellations, and claims involving damaged merchandise are governed by our Return and Refund Policy.
Because many Mineral Treasury specimens are one-of-a-kind natural objects, customers should carefully review photographs, descriptions, measurements, and other listing information before purchasing.

The Services, including Mineral Treasury trademarks, branding, logos, text, product descriptions, photographs, graphics, videos, educational materials, website design, and other original content, are owned by Mineral Treasury or its licensors and are protected by applicable intellectual property laws.
These Terms permit use of the Services for personal, non-commercial purposes.
Except where permitted by law, you may not reproduce, distribute, modify, republish, sell, commercially exploit, or create derivative works from Mineral Treasury content without prior written authorization.
Nothing in these Terms grants you ownership or licensing rights in Mineral Treasury's intellectual property except as expressly stated.
Shopify's trademarks and intellectual property remain the property of Shopify and its applicable affiliates or licensors.

Mineral Treasury is powered by Shopify, which enables us to provide the Services to you.
However, sales and purchases made through our store are transactions directly between you and Mineral Treasury.
By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales between you and Mineral Treasury, including injury, damage, or loss resulting from products purchased from Mineral Treasury.
To the extent permitted by applicable law, you release Shopify and its affiliates from claims, damages, and liabilities arising from or relating to purchases and transactions with Mineral Treasury.

If an error materially affects an order already submitted, we may contact you regarding the error and, where appropriate, modify or cancel the order and issue any required refund.

Some jurisdictions do not permit certain warranty exclusions, so some exclusions may not apply to you.
SECTION 18 – LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MINERAL TREASURY AND ITS OWNERS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THE SERVICES.
THIS MAY INCLUDE, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF USE, OR SIMILAR DAMAGES.
Nothing in these Terms excludes liability that cannot legally be excluded or limited under applicable law.

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Mineral Treasury and its affiliates, owners, officers, employees, agents, contractors, licensors, and service providers from third-party claims, damages, liabilities, losses, costs, and reasonable attorneys' fees arising from your material violation of these Terms, violation of applicable law, infringement of third-party rights, or misuse of the Services.

These Terms, together with our Privacy Policy, Return and Refund Policy, Shipping Policy, and other policies incorporated by reference, constitute the agreement governing your use of the Services.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
